1. Scope of this policy
This policy explains how Ives Construction, LLC ("Ives Construction", "we", "us") handles personal information collected through ives.construction (the "Site").
It does not cover information we collect offline, information we receive as part of a signed construction contract or an active project, employment applications, or the practices of any third-party website we link to.
2. Information we collect
Information you give us
When you submit the bid request form or email us, we collect what you choose to provide:
- your name and, if you provide it, your company and role;
- your email address and phone number;
- property details — address or name, unit count, scope of work, timing;
- anything else you write in the message field or attach to an email; and
- your consent to be contacted.
Required fields are marked on the form. Everything else is optional, though leaving fields blank may mean we need to come back to you before we can price work.
Information collected automatically
Our hosting and security provider records standard server and network data when a page is requested. This typically includes IP address, the date and time of the request, the page or file requested, HTTP status, referring URL, and browser and device user-agent string. This data is used to deliver the Site, keep it available and defend it against attack.
What we do not collect
We do not run advertising trackers, social media pixels, session recording or heat-mapping tools on this Site. We do not currently run third-party web analytics. We do not ask for, and you should not send us, government identification numbers, financial account numbers, payment card details, health information or other sensitive categories of personal data through this Site.
3. How we use information
- to respond to your enquiry and to prepare a walk-through, scope, budget, proposal or bid;
- to contact you about the project you asked about, by email or phone;
- to maintain internal records of enquiries, bids and the projects they become;
- to operate, secure, troubleshoot and improve the Site;
- to prevent spam, abuse and fraudulent submissions; and
- to comply with legal obligations, and to establish, exercise or defend legal claims.
We do not use information submitted through the Site to send marketing newsletters or bulk promotional email. If that ever changes, we will ask for your consent first and every message will carry an unsubscribe link.
4. Why we are allowed to use it
Where a legal basis is required, we rely on one of the following:
- Your consent — given when you tick the consent box and submit the form. You can withdraw it at any time.
- Steps taken at your request before entering a contract — scoping, estimating and bidding work you asked us to price.
- Our legitimate interests — running and securing the Site, preventing abuse, keeping business records, and responding to enquiries about our services.
- Legal obligation — where retention or disclosure is required by law.
5. Cookies and local storage
This Site does not use advertising or analytics cookies, and it does not track you across other websites.
The Site stores one item in your browser's local storage, under the key
ives-a11y. It records the accessibility preferences you choose in the
accessibility panel — text size, high contrast, underlined links, readable font and reduced
motion — so the Site looks the way you set it next time you visit. It stays on your device,
is never transmitted to us, and contains no identifier.
You can clear it at any time by pressing "Reset to default" in the accessibility panel, or by clearing site data in your browser. Clearing it only resets your display preferences.
Our hosting and security provider may set a strictly necessary cookie to identify and block malicious traffic. It is used for security only and is not used for advertising or profiling.
6. Who we share information with
We share personal information only as described here:
- Service providers. Companies that host the Site, protect it from attack, and transmit the email generated by the contact form. They may process information only on our instructions and only to provide those services.
- Project participants. Where it is necessary to price or deliver the work you asked about, we may share relevant details with subcontractors, suppliers, architects, engineers or inspectors. We share the minimum required — typically scope and property details rather than your personal contact information, unless direct coordination is needed.
- Professional advisers. Our lawyers, accountants, auditors and insurers, where reasonably required.
- Legal and safety. Where we are required to by law, subpoena or court order, or where disclosure is necessary to protect our rights, property or safety, or that of others.
- Business transfer. If Ives Construction is involved in a merger, acquisition, financing or sale of assets, information may transfer as part of that transaction, subject to this policy.
7. We do not sell your information
We do not sell personal information, and we do not share it for cross-context behavioural advertising, as those terms are used under United States state privacy laws. We have not done so in the preceding twelve months.
8. How long we keep information
- Enquiries that do not become projects: normally kept for up to three years, then deleted or anonymized.
- Enquiries that become bids or contracts: kept with the project record for as long as needed for the project, our warranty obligations, insurance and tax records, and the applicable Ohio limitation periods for construction claims.
- Server and security logs: retained for a short period, typically measured in days to a few months, in line with our provider's standard configuration.
We delete or anonymize information once it is no longer needed for the purpose it was collected for.
9. How we protect information
The Site is served over HTTPS. Form submissions are transmitted over an encrypted connection and delivered to our business email. We limit internal access to the people who need it, and we use reputable providers for hosting and email transmission.
No method of transmission or storage is completely secure. Please do not send confidential or sensitive material through the Site — contact us first and we will arrange a suitable method.
10. Your choices and rights
Subject to applicable law, you may ask us to:
- Access — tell you what personal information we hold about you and provide a copy;
- Correct — fix information that is inaccurate or incomplete;
- Delete — erase information we no longer have a lawful reason to keep;
- Restrict or object — limit how we use it, or object to processing based on legitimate interests;
- Withdraw consent — at any time, without affecting what we did before you withdrew it; and
- Stop contacting you — simply reply to any message, or email us at the address below.
Email legal@ives.construction to make a request. We will respond within 45 days, and will tell you if we need longer. We may need to verify your identity before acting, and we will not discriminate against you for exercising a right.
We may need to retain certain information despite a deletion request — for example where it forms part of a contract record, is required for tax or insurance, or is needed to establish or defend a legal claim. If so, we will tell you.
11. State-specific rights
Residents of US states with comprehensive privacy laws — including California, Colorado, Connecticut, Virginia, Utah and Texas, among others — have rights to know, access, correct, delete and obtain a portable copy of their personal information, and to opt out of sale, targeted advertising and certain profiling. As stated above, we do not sell personal information, do not share it for targeted advertising, and do not use it for automated decision-making or profiling that produces legal or similarly significant effects.
You may use an authorized agent to make a request on your behalf, with written proof of authorization. If we deny a request, you may appeal by replying to our response with the word "Appeal" and your reasons; we will respond to an appeal within 45 days and, if we again deny it, will tell you how to contact your state Attorney General.
12. Children
The Site is directed to property owners and businesses, not to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided information to us, contact us and we will delete it.
13. Where information is processed
Ives Construction operates in the United States and the Site is hosted on infrastructure that may serve content from locations around the world. Information you submit is processed in the United States. If you are outside the United States, you understand that your information will be transferred to and processed in a country whose data protection laws may differ from those in your own.
14. Changes to this policy
We may update this policy from time to time. The "Last updated" date above reflects the most recent change. If a change is material, we will make it prominent on the Site. Continued use of the Site after a change means you accept the updated policy.
